Separating is never easy, it is often complex and nuanced. Let us take some of the burden off your shoulders so you can focus on building your new life.
When two parties separate in New Zealand, ordinarily the provisions of the Property (Relationships) Act will apply. This Act governs how your property needs to be divided. Often this can be simple, however in almost every instance a lawyer will be required to ensure you comply with the provisions of the Act. This means that both you and the other party will need to have legal representation to satisfy those provisions.
Whether your matter is as simple as having one party purchase the family home off the other or it is as complex as navigating an interlinked company and trust structure — We will be able to assist.
These disputes are often two sides of the same coin and we understand that sometimes separation can create tension between parties. Our job is to de-escalate the situation as much as possible and act in your interests for an expedient and inexpensive resolution.
While there are a variety of in court and out of court options available, we will work towards the best option for your situation.
With lawyers and legal executives across both offices, we are equipped with a wide range of legal knowledge and experience.
We welcome everyone into our offices, whether you’re coming straight from the office, school drop off or the farm — step inside so we can get started and get you sorted right away.

Rainey Collins Lawyers
This three partner, eleven lawyer firm is organised into three broad teams supervised by the partners. Business, Property & Personal Legal Services (Claire Tyler), Māori Legal Issues (Peter Johnston) and Dispute Resolution & Litigation (Shaun Cousins).
The origins of Rainey Collins can be traced to 1919 when Mr R. Collins commenced practice. He took Mr W. Rainey into partnership shortly thereafter. Since those times the firm has undergone three mergers and its name has changed to accommodate these developments and the appointment of partners to the High Court Bench. In 1957 Mr McCarthy (later Sir Thaddeus McCarthy, President of the Court of Appeal) was appointed to the then Supreme Court.
The name was changed in 1961 to Rainey Collins Armour and Boock when Mr W. Leicester followed Mr McCarthy onto the bench. In 1986 the firm merged to become Rainey Collins & Olphert and in 1991 the practice merged with Wright & Co of Auckland.
The name was changed to Rainey Collins in 2003.

Acting for people from all walks of life, our lawyers are highly skilled, caring and practical. We pride ourselves on giving outstanding legal service, access to justice and our contribution to the legal and wider community. TDSL started life in 1995 as a specialist litigation and disputes resolution firm. Nearly 30 years later, we have grown to offer a range of legal services, so we can be with our clients on their whole life journey.
As a large litigation practice, our court lawyers have the skills and experience to represent our clients in any courtroom in the country.
Thomas Dewar Sziranyi Letts are widely recognised as leading practitioners in family law. Our firm has extensive experience handling complicated family law disputes and regularly receives referrals from colleagues on matters requiring in depth family law knowledge and experience.
Family law disputes must be handled in a way which causes the least possible harm to important ongoing family relationships. We strongly encourage our clients to participate in alternative dispute resolution methods, such as private mediation, where appropriate.

In the event that litigation becomes necessary, we will leverage our extensive experience as litigation lawyers to achieve the best possible outcome for our clients through the Court process.

Kumutoto Chambers
We are experienced family lawyers in the Wellington region. If you have a family law problem, you are usually going through a really stressful time. We will always give expert, sensible and tailored advice, guide you through the process to get certainty and the best possible outcome.
Ending a relationship is often stressful and difficult. You may also have children and/or own property or rent together. There are important things you need to do as soon as possible to ensure your interests and assets are protected.
If you are a concerned grandparent or caregiver of a child involved with Oranga Tamariki and want to have legal permamency (parenting order or special guardianship), we can advise about your options, help you negotiate a support package from the Ministry and represent you in the Family Court.
If you are worried about a family member who has lost capacity to make decisions about their care and property through illness or injury and they do not have enduring powers of attorney in place, you will need to make an application to the Court under the Protection of Personal Property Rights Act (PPPR). We can assist in preparing an application for someone to be appointed Property Manager and/or Welfare Guardian, as well as further applications where previous orders are set to expire.
Family break ups can be complicated, emotional and a cause for stress and conflict. Even if a parenting plan is agreed, there can often be ongoing issues over what school they attend, where they live, where they spend holidays, or one party simply not sticking to what’s agreed.
We help families negotiate, resolve and formalise day-to-day care, guardianship disputes, parenting orders/agreements, breaches of parenting orders, and access or visitation, all the while focussing on what’s best for the child/children involved.
