Advocacy Service
Welcome to our new Advocacy Service. We provide an independent nationwide service for anyone unhappy with an ACC decision or the length of time they’ve been waiting for a decision to be made.
The first step is our Pathways to Resolution. This is a confidential discussion about your situation and the options that are available so that you can decide what to do next. We aim to have this discussion with you within a day or two.
Once you have completed the Pathways to Resolution discussion you can decide to use our Advocacy Assistance then you can appoint us to be your advocate. We will look at the options to resolve the issues and arrange a conciliation meeting. We will be in touch with you to arrange your first meeting with your advocate within a few days of you deciding to use this service and appointing us to be your advocate.
If you decide not to resolve your dispute by agreement with ACC at the conciliation meeting, then you have the choice to continue to a case conference and then a review hearing.
Our Advocacy Service is staffed by specialists who offer independent representation and assistance in matters related to the Accident Compensation Corporation (ACC) of New Zealand. However, please note we are completely independent of ACC and not formally affiliated with, endorsed by, contracted to, or sponsored by ACC. The key feature of New Zealand’s accident compensation scheme is cover. Cover means that ACC recognises your injury, and may mean that you can receive compensation and rehabilitative assistance. ACC can help you with medical costs, work retraining and specialist equipment you need.
If ACC declines to cover your injury or decides not to provide you with entitlements, we can challenge that decision on your behalf.
Once we’ve lodged a challenge against a decision, ACC will appoint an independent reviewer to hear your issue. We’re able to represent you at a review hearing, and we can take care of any preparation required. Over our years in practice, we’ve developed close working relationships with many medical professionals, who are able to provide evidence to assist your case.
Following the review hearing, the reviewer will issue a binding decision. If you’re not satisfied with the result of your review hearing, you have the right to appeal to the District Court, which will issue a new decision. In some cases, you may have the right to appeal a District Court decision to the High Court and then Court of Appeal.
We’re also able to assist you with representation and advice in any other dealings with ACC. If you want representation at general meetings with ACC, or at any medical assessments you are required to attend, we are able to assist you with preparation. Our lawyers are also able to attend meetings and assessments with you, to ensure that your views are heard and that you are treated fairly. We’re also experienced at representing clients in mediation hearings and fraud investigations by ACC.

ACC, Mental Health and Criminal Law specialist, John Miller, has always been an advocate of “working in any area of law that helps human beings,” but he was particularly attracted to accident compensation work because of his father, who sustained serious brain injuries after a rogue stone was thrown into the train he was driving.
Born in Edinburgh, Scotland, John left school at 16 to work for the Admiralty; but restless and keen to see the world, he decided at age 17 to ship to New Zealand to work for the Government for two years.
He planned to return to Scotland to study at Leith Nautical College, but after meeting his future wife, writer and former nurse Stephanie de Montalk, they moved to the Hawkes Bay where John became a social worker for Social Security and Child Welfare.
He worked full time in various legal jobs while studying law full time at Victoria University and upon graduating, he was appointed a lecturer and set up his sole practice.
With some significant and groundbreaking successes under his belt, John was awarded a Millennium Human Rights Award for assisting the seriously injured, voted the Dominion Post Wellingtonian of the Year and made an Honorary Fellow of the Royal College of Physicians. In 2006, Victoria University of Wellington dedicated an annual John Miller Community Service Award for law students demonstrating an outstanding contribution to the community.
